Mr. McCarthy has over 30 years experience as primary trial and appellate counsel. His litigation experience in both state and federal courts includes serving as both plaintiff and defense counsel on contract disputes, construction claims, civil rights actions, unfair trade practices, employment discrimination claims and personal injury actions.
Practice Background
His Labor and Employment experience includes administrative proceedings before the Equal Employment Opportunity Commission, New York State Division of Human Rights and New York State Department of Labor. He has represented municipal governments in all aspects of public sector labor matters, including collective bargaining and administrative hearings before the New York State Public Employment Relations Board, and has counseled public and private sector entities on issues such as employee discipline, work place safety, and best practices for employment rules and procedures. His broad experience also includes representing clients before state administrative agencies in contract and procurement matters, as well as issues of regulatory oversight, in anticipation of or in order to avoid litigation.
Education, Admittances and Associations
A graduate of Dartmouth College and Albany Law School, Mr. McCarthy is admitted to practice in New York State and the United States District Court for the Northern District of New York. He has appeared pro hac vice in a number of other state and federal courts. He is a member of the American, New York State, Albany County, Saratoga County, and Rensselaer County Bar Associations. He lives in Loudonville, NY with his wife, Eileen. They have three grown children.
